A BILL to amend article one, chapter thirty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended,
be amended by adding thereto a new section, designated
section six-a, relating to persons licensed by another state
to provide professional services and requiring a fee for
certain services.
Be it enacted by the Legislature of West Virginia:
That article one, chapter thirty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section six-
a, to read as follows:
ARTICLE 1. GENERAL PROVISIONS APPLICABLE TO ALL STATE BOARDS OF
EXAMINATION OR REGISTRATION REFERRED TO IN CHAPTER.
§30-1-6a. Fee for services performed by professionals licensed
in another state.
Any person, not licensed to provide professional services in
this state holding a license to provide professional servicesfrom another state which has substantially the same standards
and educational requirements for licensees as are required of
licensed professionals in this state, shall, before providing any
professional services in this state, pay a fee of five hundred
dollars to the state licensing board for the profession of the
person seeking to provide the service. This section does not
confer any new privilege or right on any person not licensed in
this state. This section applies only to licensed professionals
who by reason of reciprocity, need or comity are allowed by
statute to perform professional services on a short term,
temporary, isolated or unique basis without obtaining a license
from this state.
NOTE: The purpose of this bill is to require people
licensed by another state to perform professional services to pay
a fee of $500 to perform a service in this state if they are
authorized by law to perform a professional service in this state
without obtaining a license.
